Powers of Attorney

Powers of Attorney are extremely important and useful estate documents for while you are alive.

They are for your benefit, convenience, and protection. They should not be just a standard one-page document prepared by a non-lawyer that has limited usefulness – we see these often and we have to break the distressing and life altering news to the enquiring client that the document does not give them the power to do what they seek to do. Commonly seen future circumstances should be taken into account when a power of attorney is drafted and we do just that. Powers of attorney can offer flexibility if your partner is no longer able to live with you, such as if they living in a medical care facility. If you wish to sell the jointly owned home, for instance – which is not an uncommon situation that clients find themselves in, in later years, the law would normally require you to hold half of the sale funds in trust for the other owner until they pass away. This means that while they reside in extended care, for instance, you only have access to half of the sale proceeds. This can severely minimize your access to finances and alternate housing. We can craft powers of attorney to grant the trusted attorney special permissions that the parties might find useful.
